Competition Period

12.01am (AEST) on 28/04/2022 to 11.59pm (AEST) on 08/05/2022.

Who can enter?

Only Australian residents, excluding those from the Australian Capital Territory, who are aged 18 or over.

Who can’t enter?

Directors, officers, management and employees (and their immediate families) of:
(a) the Promoter; and
(b) the agencies, companies or participating premises associated with this competition.

Where will the competition run?

The competition will run at participating campsites which are displaying promotional material (Campsites) in Australia, excluding the Australian Capital Territory.

The participating Campsites are as follows:

Megalong Valley Farm; 993 Megalong Valley Rd, Megalong Valley NSW 2785;
Bluff Creek Campgrounds, 44 Wilcox Rd, Kenilworth QLD 4574;
Undara Experience Mount Surprise Post Office QLD 4871;

King Canyon Resort, PMB 136 Alice Springs, NT 0871;

Entry instructions

To enter, you must:
(a) book a minimum one night stay at a participating Campsite during the Competition Period (depending on which participating Campsite you have chosen, you may need to book a minimum of two nights stay. Please enquire with your chosen Campsite on their minimum stay policy);
(b) confirm your 18+ identification with Campsite reception upon arrival (which must match the booking details);
(c) opt in to this competition and sign the liability waiver documentation required by the Promoter at Campsite reception;
(c) visit the Website on 07/04/2022 to receive a clue to where to find the hidden marlins at a participating Campsite (Note, the hidden marlins will only be available to find after 12pm (AEST) on 28/04/2022);
(d) after 12pm (AEST) on 28/04/2022 (the start day of the Competition Period), visit the reception at the Campsite and/or visit the Website and click on the Campsite where you are staying to receive a clue to find where the hidden marlin at that Campsite is located;
(e) once you have a clue, carefully and safely attempt to find a hidden marlin at that Campsite based on the information provided in the clue. There is a maximum of one hidden marlin per Campsite and it will remain at the same location until it is found. You can visit the Website and Social Media Channels to see if the marlin is still hidden at the Campsite you are staying at.

  • If by 12pm (AEST) on 02/05/2022 there are any hidden marlins remaining at any Campsite, visit the reception at the Campsite and/or visit the Website to receive a second clue to find where the hidden marlin at that campsite may be found. No further clues will be offered after this time.
  • Then, if you have found a hidden marlin during the Competition Period:

(f) present the physical marlin at the Campsite reception with your 18+ identification to verify that you have located an official marlin; and
(g) once verified, you will be deemed a minor prize winner and you will also be entered into the major prize draw. For the avoidance of doubt, only a minor prize winner can enter the major prize draw.

How many winners will there be and how will they be chosen?

There will be up to 11 winners determined in respect of this competition, depending on how many hidden marlins are successfully located and verified during the Competition Period. There will be up to 10 minor prize winners and 1 major prize winner.

Minor prize winners

There will be a total of 10 hidden marlins distributed to selected participating Campsites.

If you find a hidden marlin you will win a minor prize.

Major prize winner

All minor prize winners are eligible to enter the major prize draw. There will be 1 major prize draw conducted.

The draw will be held at 12pm (AEST) on 11/05/2022 at Gadens Lawyers, L13 447 Collins Street, Melbourne VIC 3000.

The first valid entry drawn randomly from the minor prize winner entries received during the Competition Period will win the major prize.

The Promoter may draw additional reserve entries in the draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants)

What can I win?

There are up to 11 prizes available – 10 minor prizes and 1 major prize.

Minor prizes

Each minor prize is a $500 Digital BCF Voucher.

Major prize

The major prize is a $10,000 Digital BCF Voucher, awarded in the form of 4 x $2,500 Digital BCF Vouchers.

If you win, your prize will be sent to the email address submitted with your entry.

Redeemable at participating BCF stores. This gift card does not expire and is partially redeemable. Not redeemable for cash and no change will be given. Where the cost of the purchase exceeds the available card balance the card holder will be required to make the difference with an alternative form of payment. Total prize pool

The minor prize pool is up to $5,000.

The major prize pool is $10,000.

The total prize pool is up to $15,000.

How many times can I enter?

You can enter and search for a hidden marlin multiple times provided you only enter once per hidden marlin. Each entry must be submitted separately in accordance with these Terms and Conditions.

How and when will the winner/s be informed?

Before the end of the Competition Period, present the physical marlin to the staff at reception at the Campsite where you are staying to find out how to verify your entry and claim your minor prize.

Minor prize winners will also have their name and state/territory of residence published on the Social Media Channels immediately after the found marlin has been successfully
verified.

The major prize winner will be notified by phone and in writing (by email) within two days of determination and will also have their name and state/territory of residence published on the Social Media Channels on 16/05/2022 for a minimum period of 28 days.

Proof of entry

You must keep the following as proof for all entries:

  • physical marlin

If you don’t produce the above proof for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize.

Proof must be identical to that provided by you with your entry.

If, in the Promoter’s opinion, you have shared any proof with another person, your entries will be invalid and you will lose any right to a prize.

Unclaimed prize/s

Any un-won or unclaimed prize/hidden marlin remaining at the end of the Competition Period will be discarded and the Promoter will withdraw any remaining hidden marlin/prize as un-awarded.

Major prize claim date: 5pm (AEST) on 11/08/2022.

Unclaimed major prize determination: 12pm (AEST) on 12/08/2022 at the same location as the original draw.

If the major prize has not been accepted or claimed by the major prize claim date above or if, after making all reasonable attempts, the Promoter can’t contact a major prize winner (or a winner does not contact the Promoter) by the major prize claim date above, the relevant entry will be discarded and the Promoter will re-award the relevant prize to a Reserve Entrant and/or carry out an unclaimed prize draw at the date, time and place stated above to randomly distribute the prize. Any such major prize winners will be informed by phone and in writing by email within two business days of determination and will also have their name and state/territory of residence published on the Website on 16/08/2022 for a period of 28 days.

If any prize or hidden marlins that remain un-won at the end of this competition that information will be published on the Website on 09/09/2022.

Collection and use of your personal information

If you are a winner, you must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You consent to the Promoter using your name and image in any promotional or advertising activity.

The Promoter may collect your personal information directly or through its agents or contractors. The Promoter will use your personal information to conduct and manage the competition. The Promoter may disclose your personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you or storing data. This may include disclosures to organisations outside Australia including in places such as the New Zealand, the UK and the Netherlands.

By entering, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging. By entering, you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility.

The Promoter’s Privacy Policy (see www.asahi.com.au/privacy) includes information about:

(a) how to seek access to the personal information the Promoter holds about you and seek correction of the information; and

(b) how to complain about a privacy breach and how the Promoter will deal with such a complaint

If you have marked the “opt-in” box on the entry form relating to We Are Explorers Pty Ltd (We Are Explorers) your personal information, you consent to the storage of your personal information on the We Are Explorers database and they may use this information for future promotional and marketing purposes regarding their products and services including contacting you via electronic messaging. You should contact the We Are Explorers for its privacy policy.

1 These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.

Entry

2 Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. Where relevant, entry forms from any other competition cannot be used for this competition, and are void if copied, forged, stolen or interfered with. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.

Prizes

3 Prize/s and all elements of prizes must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prizes are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including, as relevant validity period/s.

4 The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.

General

5 Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).

6 If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter’s discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter’s satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

7 You must not:
(a) tamper with the entry process;
(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related
entities or of the agencies or companies associated with this competition;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.

8 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

9 If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.

10 Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.

11 By entering, you request that your full address not be published.

12 Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim.

13 If this competition cannot run as planned for any reason beyond the Promoter’s control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, pandemic, public health orders and the like, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.

14 The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

Liability

15 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).

16 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).

17 Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant). Unless otherwise specified, prize/s will only be delivered to addresses in Australia.

18 This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
